Terms of Service

[COMPANY NAME] (“we”, “us”) provides an AI-powered messaging assistant that connects to your WhatsApp, Instagram, and Facebook accounts to engage customers on your behalf (“the Service”). You are responsible for the content and accuracy of the business information you provide to the Service.

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account, including that of any team members you invite.

The Service is billed on a pay-as-you-go credit basis, not a recurring subscription. Credits are purchased in advance and consumed as the AI processes messages, images, and voice notes on your behalf.

Purchased credits do not expire and are non-refundable except where required by applicable law, or at our discretion in cases of demonstrated billing error. Once your credit balance reaches zero, the Service will stop generating AI replies for your account until you purchase more credits; messages your customers send during this time are still recorded but not automatically answered.

Payments are processed by Stripe. By purchasing credits you agree to Stripe’s terms in addition to these.

You may not use the Service to send unsolicited bulk messages, harass or deceive recipients, transmit unlawful content, or violate WhatsApp’s, Meta’s, or any connected platform’s own terms of service. We may suspend accounts that we reasonably believe are being used this way.

The Service depends on WhatsApp, Instagram, Facebook, OpenAI, and Stripe remaining available and unchanged. We are not responsible for outages, policy changes, or account restrictions imposed by these third parties, though we’ll make reasonable efforts to keep the Service working as they evolve.

To the extent the Service processes personal data of your customers on your behalf, our Data Processing Agreement is incorporated into these Terms by reference and governs that processing.

Replies are generated automatically by an AI model grounded in the business information you provide. While we apply guardrails to reduce inaccurate or inappropriate responses, we cannot guarantee every AI-generated message will be perfectly accurate. You are responsible for reviewing your knowledge base content and monitoring conversations, particularly during initial setup.

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these terms. Unused credit balances are non-refundable on voluntary account closure, except where required by law.

The Service is provided “as is.” To the maximum extent permitted by law, [COMPANY NAME] is not liable for indirect, incidental, or consequential damages, including lost sales or lost leads, arising from use of the Service.

We may update these terms as the product evolves. Continued use of the Service after a change constitutes acceptance of the updated terms.
